Terms & Conditions
These Terms and Conditions govern the provision of genomic testing and analysis services by DNAIQ Pty Ltd.
Effective Date: July 13, 2025
1. Definitions
1.1 "DNAIQ," "we," "us," or "our" refers to DNAIQ Pty Ltd, ABN [Company Number], a company incorporated in Victoria, Australia.
1.2 "Client" or "you" refers to the individual or organization requesting genomic testing services.
1.3 "Services" refers to genomic testing, analysis, and related bioinformatics services provided by DNAIQ.
1.4 "Sample" refers to biological material provided for genomic analysis.
2. Service Agreement
2.1 These Terms constitute a binding agreement between DNAIQ and the Client upon acceptance of a service request or sample submission.
2.2 Services are provided subject to sample quality, quantity requirements, and technical feasibility.
2.3 DNAIQ reserves the right to refuse service requests that do not meet our technical specifications or ethical guidelines.
3. Sample Requirements and Handling
3.1 Clients must ensure samples are collected, stored, and transported according to DNAIQ specifications.
3.2 Samples must be accompanied by appropriate documentation and consent forms where required.
3.3 DNAIQ will handle samples in accordance with applicable laboratory standards and regulations.
3.4 Sample retention periods and disposal procedures will be communicated prior to testing.
4. Results and Reporting
4.1 Results will be provided in the format and timeframe specified in the service agreement.
4.2 Results are based on current scientific knowledge and analytical methods available at the time of testing.
4.3 DNAIQ provides technical analysis only and does not provide medical diagnosis or treatment recommendations.
4.4 Results should be interpreted by qualified healthcare professionals or researchers as appropriate.
5. Quality Assurance
5.1 DNAIQ maintains NATA accreditation and operates under stringent quality standards.
5.2 Quality control measures are implemented throughout the testing process.
5.3 Any quality issues will be investigated and reported according to our quality management system.
6. Privacy and Confidentiality
6.1 DNAIQ maintains strict confidentiality of all client information and test results.
6.2 Personal information is handled in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.
6.3 Genomic data may be de-identified and used for quality improvement and research purposes unless specifically prohibited by the client.
7. Limitation of Liability
7.1 DNAIQ's liability is limited to the cost of re-testing or refund of fees paid for the specific service.
7.2 DNAIQ excludes liability for indirect, consequential, or special damages.
7.3 No warranty is provided regarding the suitability of results for any particular purpose.
8. Payment Terms
8.1 Payment terms are specified in individual service agreements.
8.2 Overdue accounts may incur additional charges and may result in suspension of services.
8.3 All fees are in Australian dollars unless otherwise specified.
9. Intellectual Property
9.1 DNAIQ retains ownership of analytical methods, processes, and proprietary technologies.
9.2 Clients retain ownership of their biological samples and resulting genomic data.
9.3 Reports and analysis provided by DNAIQ may not be reproduced without permission.
10. Regulatory Compliance
10.1 Services are provided in compliance with applicable Australian regulations and quality standards.
10.2 Clients are responsible for ensuring appropriate regulatory approvals for their use of testing services.
10.3 Export of results may require additional regulatory approvals.
11. Termination
11.1 Either party may terminate services with written notice.
11.2 Completed work will be charged according to the agreed fee schedule.
11.3 Sample disposal will follow standard laboratory procedures unless alternative arrangements are specified.
12. Governing Law
12.1 These Terms are governed by the laws of Victoria, Australia.
12.2 Disputes will be subject to the jurisdiction of Victorian courts.
12.3 Mediation may be pursued prior to legal proceedings where appropriate.
13. Amendments
13.1 DNAIQ may update these Terms with reasonable notice to clients.
13.2 Continued use of services constitutes acceptance of updated Terms.
13.3 Specific service agreements may include additional terms that supplement these general Terms.
